FCC Initiates “Net Neutrality” Review



The Federal Communications Commission (FCC) in March announced plans to explore practices of broadband providers. This “notice of inquiry” is seeking public comment on how broadband providers manage their networks, including whether or not they charge different prices for different speeds or “capacities” of their service. The notice also seeks information on how consumers are impacted by these business practices.

While the FCC does not have “net neutrality” regulations, the Commission adopted an Internet Policy Statement in 2005. This statement lays out four guiding principles for broadband providers, including the principle that “consumers are entitled to access the lawful Internet content of their choice.” To date, the FCC has not had a reason to enforce these principles. The current notice of inquiry seeks to determine whether this policy statement should be amended to include a new principle of non-discrimination.
